“GutZy’s Double Giveaways” Terms and Conditions

(“Terms and Conditions”)

These Terms and Conditions shall apply to the "GutZy’s Double Giveaways" (the "Giveaway Event") being run on Instagram (the "Social Media Platform"). By participating in this Giveaway Event, you agree to be bound by these Terms and Conditions.

1. Organiser

The Tapping Tapir Sdn Bhd, a company incorporated in Malaysia with the registered office address at No. 38, Jalan 6/2, Kawasan Perindustrian Seri Kembangan, 43300 Seri Kembangan, Selangor, Malaysia. (the "Organiser").

1. Participants & Eligibility

The Giveaway Event is open to all Malaysian citizens and permanent residents aged eighteen (18) years old and above at the time of entry with a valid postal delivery address in Malaysia and valid identification documents to be provided when requested by the Organiser. Each a "Participant" and collectively, the "Participants".

To participate in the Giveaway Event, you must be a registered user of Instagram, except that the employees, officers, directors and/or agents of the Organiser, its affiliated and subsidiary companies, as well as any company involved in the Giveaway Event, and their respective immediate family members, are not eligible to participate in the Giveaway Event. You may only participate in the Giveaway Event once, using one (1) Social Media Platform account (on Instagram). 

The Organiser may require you to provide proof that you are eligible to participate in the Giveaway Event.

1. Giveaway Period

The Giveaway Event consists of two rounds:

• Giveaway Round 1: 2024 Christmas Edition
• Giveaway Round 2: 2025 Countdown Edition

The first round officially begins with the first ‘Add Yours Instagram Story Template’ at 12:00 pm (UTC +8) on 6 December 2024; and officially ends at 11:59 pm (UTC +8) on 13 December 2024 when the entry timeframe for the first ‘Add Yours Instagram Story Template’ officially ends (the "Giveaway Period").  

Similarly, the second round officially begins with the second ‘Add Yours Instagram Story Template’ at 12:00 pm (UTC +8) on 20 December 2024; and officially ends at 11:59 pm (UTC +8) on 27 December 2024 when the entry timeframe for the second ‘Add Yours Instagram Story Template’ officially ends (the "Giveaway Period").  

The following are the publication date and time of each of the relevant Instagram posts (the "Add Yours Instagram Story Template") for the Giveaway Event; and the corresponding deadline of the participation entry for each giveaway round. Participants are required to submit their entries to each ‘Add Yours Instagram Story Template’ within the stipulated time given.

Publication: 6 December 2024, 12:00 PM (UTC +8) 

Deadline: Participants must submit their entries before 13th December 2024, 11:59 PM (UTC +8) 

Publication: 20 December 2024, 12:00 PM (UTC +8) 

Deadline: Participants must complete the Challenge before 27 December 2024, 11:59 PM (UTC +8)

1. Promotion and Prizes

1. To participate in the Giveaway Event, you are required to complete all the steps in paragraph 4.1.1 below within the Promotion Period and the requirements as set out in the relevant posts on the Social Media Platform:

1. Participants must join the Giveaway Event on Instagram as a registered user on Instagram. You are required to:
   
   

1. Follow The Tapping Tapir's official Instagram (@thetappingtapir);

1. Submit their music entry to the Add Yours Instagram Story Templates;
2. Tag @thetappingtapir and tag two friends in the Instagram Story. (Users must set their account to ‘Public’.)

1. Participants are free to join either one round of the giveaway, or both rounds of the giveaway, as long as they complete the steps in 4.1.1 before the stipulated deadline for each round.

1. A total of three (3) Winners will be chosen for each giveaway round. Hence, there will be six (6) Lucky Prizes Winners in total for this Giveaway Event. Participants are qualified to be chosen as a Winner among all participants who participated within the Promotion Period, if they are able to follow the following requirements (the "Winner"):

1.          Follow the steps as stated in 4.1.1  
2. Participants who incorporate creativity into their musical entries and Instagram Story posting may be given special consideration to be potentially chosen as the Winner.

The Winners will be chosen at random amongst the qualified entries across the relevant posts on the Social Media Platform by the Organiser, at its sole discretion. The decision of the Organiser in its selection of the Winners is final and no correspondence or discussion will be entered into with any participant.

1. Subject to the Terms and Conditions, one (1) Limited Edition Christmas Bucket Hat; one (1) 15% Discount Code; and one (1) Double Mini gutC Peach Pack will be awarded to the three (3) Winners of the first Giveaway Round (the “GutZy’s Christmas Gift Set”). These prizes are non-exchangeable and non-refundable.  
2. On the other hand, one (1) gutC Peach Limited Edition Tote Bag; one (1) 15% Discount Code; and one (1) Double Mini gutC Peach Pack  will be awarded to the three (3) Winners of the second Giveaway Round (the “GutZy’s New Year Starter Pack”). These prizes are non-exchangeable and non-refundable.  
3. The list of Winners of the Giveaway Round 1 and Round 2 will be announced on 17 December 2024 and 31 December 2024 respectively on the Social Media Platform. The Organiser will contact the Winners through the Social Media Platform.
4. The Winners may be required by the Organiser to provide certain information and/or documents for verification purposes to claim the Prize in accordance with the instructions by the Organiser on the Social Media Platform.
5. If the Winner(s) cannot be contacted, is not available, or has not claimed the Prize within one (1) day from the announcement date, or fails to provide any information and/or documents as may be requested by the Organiser within the prescribed time period, the Prize will be forfeited (without any compensation or substitute), and the Organiser may choose a new Winner among all other participants who complied with these Terms and Conditions. The Organiser bears no responsibility if any Winner is unable to take up the Prize for any reason whatsoever.
6. Prizes are subject to availability. In the case that the Organiser, due to reasons outside its control, is unable to obtain said Prize(s), the Organiser may replace such Prize(s) with a similar alternative. The Organiser will not be liable to the Winners for any change to the original value or any difference in the relevant product(s) or service(s) being offered as the alternative Prize. 
7. Prizes will only be delivered to addresses within Malaysia. The Organiser, its affiliates and/or appointed agents or representatives associated with the Giveaway Event will take no responsibility for Prizes that are damaged, lost, delayed or stolen in transit.

1. Miscellaneous
1. The Organiser reserves the right to amend these Terms and Conditions as well as to vary or terminate the Giveaway Event or any of the Prizes without prior notice. In the event of any dispute, the decision of the Organiser shall be final and binding.
2. You warrant that you are the legitimate owner of the social network account used to participate in the Giveaway Event, and that the information and content contained therein are true, accurate, not misleading and do not violate the rights of any third party. 
3. Your eligibility to participate in the Giveaway Event and/or to be awarded with any Prize shall be determined by the Organiser in its sole discretion. The Organiser reserves the right, at its absolute discretion, to cancel or revoke your right to participate in the Giveaway Event or benefit from any Prizes upon any discovery of your violation of these Terms and Conditions or your dishonest, malicious, fraudulent, unlawful or, in the sole opinion of the Organiser, inappropriate acts or behaviour in the context of your participation in any Giveaway Event.
4. Any fraud and/or abuse of any Prize awarded/received under the Giveaway Event by you (as determined by the Organiser in its sole discretion) will result in the forfeiture of your eligibility to such Prize. The Organiser reserves the right to revoke, change or replace the Prize and/or take any legal action in such instances to recover any outstanding amounts without any notice. The Prize cannot be redeemed for cash, or for other gift vouchers, products or services of the Organiser. The Organiser shall have no legal liability in relation to any aspects of the Prize(s) including but not limited to their quality, delivery, warranty and maintenance.
5. In the event that the Giveaway Event is cancelled or suspended by any relevant authorities, or due to a serious network attack, system failure or any other reasons, the Giveaway Event may be terminated prematurely without notice. Such a situation shall constitute a force majeure event and the Organiser shall not be liable for any damages or claims that arise out of the force majeure event.  
6. The Organiser is not responsible for any late, lost, delayed, incomplete, illegible, misdirected or undeliverable entries, responses, or other correspondence, whether by e-mail or otherwise.  
7. You agree to grant the Organiser a non-exclusive, assignable, worldwide, irrevocable licence, for the full period of any intellectual property rights in the post you submitted and any related content and/or materials in connection with the Giveaway Event (“Content”), to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the Content for any purposes that the Organiser may deem appropriate and necessary. You agree that the Organiser may, but is not required to, make your entry and/or publish the Content available on its website, its Social Media Platforms and/or any other media, whether now known or invented in the future.
8. You guarantee that the Content and your participation in the Giveaway Event do not violate any rights of third parties and are the object of independent creativity. The Content shall not contain any offensive language, harmful or inappropriate content, rude words or other expressions of an obscene nature (as determined in the sole opinion of the Organiser).
9. The Organiser may collect personal data from you in relation to the Giveaway Event. A Winner should provide consent and agree to the Organiser’s use of personal information, such as the Winner’s full legal name, account name of the Social Media Platform used to participate in the Giveaway Event, contact number, email address and personal address for the purpose of claiming the Prize. You agree and understand that the Organiser will process your personal data in accordance with the Organiser’s Privacy Policy (which may be amended and updated from time to time). Additionally, in accepting the Prize, the winner agrees to be featured in any marketing collateral by The Tapping Tapir for publicity and announcement purposes, if applicable.
10. By accepting to participate in the Giveaway Event and/or to receive the Prize, the Winner assumes any expenses in which the Winner may incur, except for those included in the relevant Giveaway Event, as well as any liability arising from the receipt and use of the Prize(s).  In addition, the Winner shall be responsible for any taxes arising or expenses not specifically mentioned in these Terms and Conditions (if any).
11. In case of any discrepancy in the interpretation between the English and the non-English versions of these Terms and Conditions, the English version shall prevail.
12. To the maximum extent permitted by applicable law, in no event will the Organiser be liable to you for any direct, indirect, special, incidental, exemplary, punitive or consequential loss (including loss of use, loss of data, loss of business or profits) arising out of or in connection with your participation in this Giveaway Event, whether such liability arises from any claim based upon contract, warranty, tort (including negligence), strict liability or otherwise, and whether or not Organiser has been advised of the possibility of such loss or damage.
13. The Organiser and/or any of its affiliates shall not be responsible, and shall have no liability to you or any third party for any dispute or claim that arises out of your participation in the Giveaway Event.
14. You agree that this Giveaway Event and these Terms and Conditions are governed, interpreted and enforced by the laws of Malaysia without regard to its conflict of laws principles. Any and all legal actions, claims or proceedings arising out of, or in connection with this Giveaway Event must be brought in a court of competent jurisdiction in Malaysia.
